Matthew: Well, that was my initial point. Once the comparisons were made, after the site was launched, the owner shouldn't have shrugged it off by saying "The sites are completely different".

Nick: And that's the problem. It's only by chance that we notice half of the thefts in the first place. I was a bit groggy when I was writing this, so it didn't come out clearly. It's definitely harder on less well known designers; we don't have the benefit of publicity. But I managed to throw in some philosophy about karma in my copyright paragraph.

There's one site that showcases fake pieces and matches originals to them - and I really can't remember the link. If any of you know, that would be great!

Thank you all for your comments! My next article will be better (hopefully) :)

I know it's impossible for designers to be aware of every other design out their, but most of the "so called designers" that try to make profit from design aren't ripping "Joe's Website Design" that no one would notice, they're ripping the big name, known designers and studios.

I think your point #2 (the first paragraph) is not really fair on clients. Depending on their industry, it is entirely unreasonable to expect them to be aware of the design of the millions of unique sites that their designer may be stealing from; I know I could have lifted the design of any popular design blog for recent clients and they would have been completely unaware that it wasn't original work.

The onus not to steal is completely on the designer at that point (although I agree that once the owner is made aware of the theft that they should do more about it than Faulkner did).

Great first article! I would probably cry if I found out someone was stealing my content, but there are certain scripts to help with that. Stealing designs is a whole other ballgame.

Great article. Seriously.

However, I'm not very optimistic and I think this is just the beginning. The Intenet is getting more and more global and wide-spread and nowadays free tools and services enable even a blind one-handed monkey to build its own website. Then the only thing left to do is getting a design for your site. If you can't find a pretty theme for free out there, you'll steal an existing design, and it's done! It's just too easy.
Oh, well, then you can call yourself a web designer and sell your (stolen) designs for profit. Ta-da!

And we, as designers, can't do much to avoid this.
Copyright and lawsuits won't help us.

The point is to make our blog readers, and moreover our clients, aware of the difference between clones and real custom-made designs, between a wanna-be amateur designer and a professional, between creativity and imitation.

My 2 cents... and sorry for wasting so much space ;-)
